Plea filed to challenge HC verdict on proclamation of independence
June 23, 2009
An appeal application was filed today with the Appellate Division against the High Court judgement declaring Bangabandhu Sheikh Mujibur Rahman as the proclaimer of the independence of the republic.
Retired wing commander Hamidullah Khan, also a BNP leader, filed the provisional leave-to-appeal seeking an order staying the HC verdict.
Hearing of the petition may be held tomorrow.
Hamidullah was an added party of the writ petition upon which the HC delivered the judgement on June 21.
His lawyer Barrister Nasiruddin Asim told The Daily Star that the HC judgement split the nation by its judgement that Sheikh Mujibur Rahman declared independence of the country.
In the petition, Hamidullah said Ziaur Rahman first declared the independence from Kalurghat Radio Station on March 27 in 1971.
