Proclaimer of independence: SC refrains from passing order on petition

June 24, 2009

The Supreme Court (SC) today did not interfere in the High Court (HC) judgement that declared Bangabandhu Sheikh Mujibur Rahman as the proclaimer of the independence of the republic.

Chamber judge of the Appellate Division Justice MA Aziz refrained from passing any order on this provisional leave-to-appeal petition filed against the HC judgement.

After holding a brief hearing, the chamber judge passed ‘no order’ on the petition filed by Wing Commander (retd) Hamidullah Khan, a freedom fighter and a BNP leader.

Attorney General Mahbube Alam told The Daily Star that following the chamber judge’s order the HC verdict apparently remain upheld.

Hamidullah yesterday filed the appeal petition with the SC to stay the HC verdict.
