Challenge to war tribunal judges rejected

The High Court on Tuesday summarily rejected a writ petition challenging the appointment of two High Court judges to the post of the chairman and a member of the International Crimes Tribunal set up for trying the 1971 crimes against humanity.

A division bench comprising Justice Mamnoon Rahman and Justice Syeda Afsar Jahan passed the order after holding hearing on the petition.

Barrister Abdur Razzaq, a central leader of the Jamaat-e-Islami and counsel for petitioners, told The Daily Star that they will file an appeal with the Appellate Davison to overturn the HC order after receiving the certified copy of the order.

Nawab Ali, a pro-Jamaat-e-Islami lawyer, and AFM Solaiman Chowdhury, a former secretary, jointly filed the writ petition with the HC on July 11 stating that as per the provision of the constitution, sitting HC judges cannot hold any other office of the republic.

The government on March 25 this year appointed Justice Nizamul Huq as chairman of the tribunal and Justice ATM Fazle Kabir as member.

Another member of the three-member tribunal is AKM Zahir Ahmad.
